Meck District Attorney's Property Team Convicts Several Defendants

During the week of March 5, 2012, the Mecklenburg County District Attorney’s Property Team called several cases for trial:

Robert Barrino, 21, was tried for felony larceny. The jury returned a verdict of not guilty.
Michael Partlow, 22, was tried for felony possession of a stolen motor vehicle. The jury returned a verdict of guilty.  Judge Levinson sentenced Partlow to 8-10 months in prison.
Rodney Eugene Jones, 40, was tried for 1) first degree burglary, and 2) felony larceny. The jury returned verdicts of guilty on the charges of 1) first degree burglary and 2) felony larceny. The defendant then admitted his status as a habitual felon.  Judge Sumner sentenced Jones to 151-191 months in prison and that sentence will run at the expiration of the prison sentence he is currently serving from a Burke County conviction. The defendant had prior convictions that include, but are not limited to, felony breaking or entering, felony larceny from the person, felony larceny of a motor vehicle, common law robbery, and sale or delivery of cocaine.

Nine defendants plead guilty before or shortly after their cases were called for trial:

Justin Alexander, 28, plead guilty to 1) felony breaking or entering and 2) felony larceny. Judge Sumner sentenced Alexander to 8-10 months in prison; that sentence was suspended pending his successful completion of 30 months of supervised probation. As conditions of probation, Alexander must serve 45 days in the county jail and pay $200 in restitution.
Jamal Floyd, 26, plead guilty during jury selection to 1) felony breaking or entering and 2) felony larceny. Judge Levinson sentenced Floyd to 8-10 months in prison.
Joe Speach, 42, plead guilty to felony embezzlement during jury selection. Judge Levinson sentenced Speach to 5-6 months in prison; that sentence was suspended pending his successful completion of 20 months of supervised probation.
Jerry Allen, 22, plead guilty to the charges of 1) felony breaking or entering and 2) felony larceny. Judge Levinson sentenced Allen to 5-6 months in prison.
Rodney Funderburk, 32, plead guilty to the charges of 1) felony breaking or entering, 2) felony larceny, and 3) resist, obstruct and delay. Judge Sumner sentenced Funderburk to 10-12 months in prison; that sentence was suspended pending his successful completion of 30 months of supervised probation. As a condition of probation, Funderburk must serve 45 days in the county jail.
Jhony Garcia-Joya, 32, plead guilty to the charges of 1) felony breaking or entering and 2) felony larceny. Judge Levinson sentenced Garcia-Joya to 6-8 months in prison; that sentence was suspended pending his successful completion of 22 months of supervised probation. As a condition of probation, Garcia-Joya must serve 24 days in the county jail.
Marquis McIlwaine, 17, plead guilty to 1) felony breaking or entering and 2) felony larceny. Judge Levinson sentenced McIlwaine to 5-6 months in prison; that sentence was suspended pending his successful completion of 20 months of supervised probation. As a condition of probation, McIlwaine must serve 10 days in the county jail.
Marcus Dawson, 18, plead guilty to two counts of Injury to Personal Property greater than $200.  Judge Sumner sentenced Dawson to 90 days in the county jail and ordered Dawson pay $377.05 in restitution.
Michael Ramirez, 24, plead guilty to possession of stolen goods. The Honorable W. Robert Bell sentenced Ramirez to 120 days in jail.
