Police searched Withers' car and they found a .32-caliber pistol. Both teens were arrested and taken to the Mecklenburg County jail. They were charged with possession of a gun on educational property.

Fonesca's first brush with the law was in 2004, when Fonesca was only 16 years old. He was charged with breaking and entering, breaking into a coin/currency machine and larceny.
