Violent Criminals on Trial; Others Plead Guilty

During a two week trial session that began on November 8, 2010 and ended on November 19, 2010. The Crimes Against Persons Team conducted four jury trials in Mecklenburg County Superior Court in two different courtrooms.

The first trial was Robert Jeremy Caldwell, 22, for robbery with a dangerous weapon and possession of a firearm by a convicted felon. The jury returned a verdict of guilty on both charges. Caldwell then entered a guilty plea to attempted common law robbery in an incident unrelated to the trial. The Honorable Eric L. Levinson, Superior Court Judge, sentenced Caldwell to 86-113 months in prison to be followed by 36 months of supervised probation after his release from prison.

The second trial was of Roderick Richardson, 34, (shsown R) for two counts of assault with a deadly weapon with intent to kill inflicting serious injury and possession of a firearm by a convicted felon. The jury returned a verdict of guilty on all three charges. The Honorable Yvonne Mims Evans, Superior Court Judge, sentenced Richardson to 120-164 months in prison.

The third trial was of Nakio Cousart, 31, for common law robbery. The jury returned a verdict of not guilty.

The fourth trial was of Harvey Massey, 30, for robbery with a dangerous weapon, conspiracy to commit robbery with a dangerous weapon, and possession of a firearm by a convicted felon. After the state presented evidence, Massey entered a guilty plea to conspiracy to commit a robbery with a dangerous weapon. The Honorable F. Lane Williamson, Superior Court Judge, sentenced Massey to 25-39 months in prison, suspended for 36 months of supervised probation with 55 days in jail.

Robert McClinton, 21, (shown R) entered a guilty plea prior to his trial. McClinton pled guilty to possession of a firearm by a convicted felon. Judge Williamson sentenced McClinton to 10-12 months in prison. (This kid received the sweetest plea deal I have ever seen! I don't know how it happened but the dismissed charges include; robbery with a dangerous weapon, attempted first degree murder, discharging a firearm into an occupied dwelling, etc. - click here to see all charges. We will see him again in 10 months...)

Jonathan Lynn, 26, entered a guilty plea prior to his trial. Lynn pled guilty to robbery with a dangerous weapon, conspiracy to commit robbery with a dangerous weapon and first degree burglary. The Honorable Linwood O. Foust, Superior Court Judge, sentenced Lynn to 156-206 months in prison. (Lynn was arrested NINE times in Mecklenburg County between 2008-2009)

Malik Whitney, 39, entered a guilty plea prior to his trial. Whitney pled guilty to possession of a firearm by a convicted felon and he admitted his status as a habitual felon. Judge Foust sentenced Whitney to 90-117 months in prison. (Whitney was arrested 7 times between 2008- 2/2010.)

Martin Reid, 32, entered a guilty plea prior to his trial. Reid pled guilty to conspiracy to commit robbery with a dangerous weapon and possession of a firearm by a convicted felon. Judge Williamson sentenced Reid to 74-99 months in prison.

Roman Johnson, 25, entered a guilty plea prior to his trial. Johnson pled guilty to conspiracy to commit robbery with a dangerous weapon. Judge Williamson sentenced Johnson to 29-44 months in prison suspended for 36 months of supervised probation with 90 days in jail.

Arbrey Moore, 26, (shown R) entered a guilty plea prior to his trial. Moore pled guilty to possession of stolen goods. Judge Levinson sentenced Moore to 10-12 months in prison.
(Another sweet plea deal. Moore has been arrested 7 times since 2008. What happened to the charges of assault with a deadly weapon- intent to KILL, tampering with his electronic device, discharging a firearm into an occupied dwelling, drug charges, etc.?? Here is another guy we will see again in 10 months, mark my words!)


Abdur Mahmood, 46, entered a guilty plea prior to his trial. Mahmood pled guilty to common law robbery. Judge Levinson sentenced Mahmood to 16-20 months in prison.

Oliver Wolfe, 46, entered a guilty plea prior to his trial. Wolfe pled guilty to assault inflicting serious bodily injury, felony breaking and/or entering, and assault on a female. Judge Foust sentenced Wolfe to 19-23 months in prison, suspended for 36 months of supervised probation.

Nelson Herron, 23, entered a guilty plea prior to his trial. Herron pled guilty to discharging a weapon into occupied property, conspiracy to commit robbery with a dangerous weapon and obstruction of justice. Judge Foust sentenced Herron to 29-44 months in prison.
