Man Charged with Rape, Sex Offenses & Kidnapping

Detectives with the Charlotte-Mecklenburg Sexual Assault Unit have charged Lavatae Nacoma Evans with 5 counts of 2nd Degree Rape, 3 counts of 2nd Degree Sex Offense and 2nd Degree Kidnapping.

On June 6, 2012 at approximately 12:00pm,  CMPD Metro Division patrol officers responded to the 2100 block of Double Oaks Road in reference to an assault. When officers arrived, the victim advised that she had been held against her will and sexually assaulted.

The victim advised that she had met the suspect at the Transit Center and gone to his residence. While at the residence, the victim was sexually assaulted multiple times. The victim was able to escape through a window of the suspect’s house and call police from a neighboring residence.

A BOLO (be on the lookout) for the suspect was initiated and a short time later officers located him at the Transit Center in the CMPD Central Division.  Crime Scene Search responded to the call for service to process the scene and collect physical evidence.

35-Year Old Charged with Statutory Rape after 14-Year Old Gives Birth

Juan Martinez Hernandez has been charged with statutory rape after a 14-year-old girl gave birth to his child on Sunday.  Police say the girl gave birth to the baby in the bathroom of an apartment near East Arrowood Road.

Her family called 911 and the responding paramedics asked police for assistance. The girl told the police officers who the baby’s father was- a man who lived in the neighborhood and Charlotte-Mecklenburg police found and interviewed Juan Martinez-Hernandez.

Hernandez “admitted to engaging in sexual intercourse with the victim on several occasions,” according to the police report. Hernandez was charged with four counts of statutory rape and two counts of indecent liberties with a child. He is in jail at the Mecklenburg County Sheriff’s Office under a $250,000 bond.

Immigration reports show that Martinez-Hernandez was deported from the US in 2010. 

Anonymous E-mail Makes CMPD 'Fess Up about Releasing Rape Suspect

The following email was sent to the Cedar Posts blog and every news outlet in Charlotte early this morning. Shortly before noon, CMPD announced a press conference at 3pm to discuss the "real story" of how they let a rape suspect go unmonitored, only for him to rape a 3rd woman...

To whom ever will listen,

The information you have received from CMPD concerning the arrest and actions of Lavantae Evans is not completely true. They have lied in an effort to cover up their mistakes which lead to an innocent person being sexually assaulted and held against her will. 

Police responded to the Sunset Inn at 5301 Equipment Dr around 6 a.m. on 12/15/2011. During this altercation Evans was named and positively identified as a suspect in the kidnapping and rape of two female subjects. Evans was found hiding in another hotel room a few doors down from where the assault took place. Once Evans was located he was positively identified as the person who raped and kidnapped the two women. He was then voluntarily transported to the Law Enforcement Center to be questioned by detectives. 

At some point Evans was allowed to leave police custody and not charged with the rape and kidnapping of the first two women. After being allowed to leave police custody he then kidnapped and raped another woman which led to the police standoff with the SWAT team responding. It was only after Evans was involved in the raping and kidnapping of a third woman that detectives went and obtained warrants for his arrest for the first two women that he assaulted. 

CMPD completely failed in this incident and allowed a dangerous, violent and disturbed individual to walk the streets and a few hours later lead to the rape of another woman that could have been completely prevented. 

Please, I implore you to dig harder and see that the information released to you by CMPD is not true in its entirety. All that I have said is documented and available for public record. Please look more into this story and report the truth about what happened with Mr. Evans and CMPD's failure to protect this community.

Sex Offender on Electronic Monitoring Charged with Rape

UPDATE:  4/24/12- Jason Miller was found dead in the Charlotte-Mecklenburg County jail this morning.  According to the Sheriff Dept, it appears to be a natural death.

It is my opinion that some criminals cannot be stopped nor rehabilitated!  For example, 38-year old Jason Lamont Miller.  He is a registered sex offender and on electronic monitoring who is accused of raping a woman in the early morning hours Wednesday on North Graham St.

Thankfully, the victim noticed the suspect was wearing an ankle bracelet so her testimony is the only reason why he was apprehended quickly.

According to a Charlotte Observer article,  Miller had been released from prison in 2010 after serving two years for taking indecent liberties with a minor, and was being monitored by authorities there, said Capt. Mike Smathers, who oversees the department's robbery and sexual assault unit.

Rapist Sentenced to 84 years in Prison

On October 26, 2011, Jarrod Willis, 30, was convicted of first-degree rape, first-degree sex offense, first-degree kidnapping and robbery with a dangerous weapon. The jury found the defendant guilty after a three-day trial in front of the Honorable Timothy S. Kincaid, Superior Court Judge, in the Mecklenburg County Courthouse.

On March 12, 2009, Willis drove up beside the victim and forced her into his car at gunpoint. He drove to a secluded location and sexually assaulted and robbed her. Forensic nurses collected DNA evidence from the victim.

Willis was developed as a suspect after his DNA was collected from an unrelated felony conviction. His DNA was put into the national database (CODIS) and he was identified as her attacker.

Judge Kincaid sentenced the defendant to a total of 1,018 - 1,259 months in prison (approximately 84-105 years)

Man Charged with Robbery & Rape

Antonio Cordira McClary, 22, is charged with first degree rape, armed robbery and first degree sex offense after he was accused of raping a woman on Tiburon Circle.

Police say they were called to Tiburon Circle on Tuesday after the victim reported someone had held her at gunpoint and raped her inside her Charlotte home.  The suspect also stole the woman's cash and cell phone.

The victim was treated at  CMC-University for minor injuries but is expected to be okay.  McClary is being held in the Mecklenburg County Jail on a $200,000 secured bond.

The Charlotte-Mecklenburg Police Department’s Violent Criminal Apprehension Team (VCAT) is currently searching for 23-year old Martin Russell Diamond.

CMPD arrested Martin 'Rashad' Diamond on May 18, 2011. He was charged with kidnapping and the brutal rape of a known acquaintance. Diamond was transported to the Mecklenburg County Jail and was being held on $105,500 secure bond.

On May, 19, 2011, a criminal court magistrate mistakenly changed the conditions of the bond to an unsecured status. The suspect subsequently signed himself out of jail that day.

On May 24, 2011, CMPD received information that the suspect had been released. CMPD detectives immediately obtained another warrant for the suspect. CMPD’s VCAT was immediately notified and prioritized the search with a full complement of VCAT staff. They continue to work at apprehending the suspect.

Martin Diamond is 6 feet tall, weighs approximately 155 pounds and has a tattoo of a cross on his shoulder.  Martin Diamond should be considered extremely dangerous. Anyone with information on his location is asked to call 911 or 704-336-VCAT (8228) or e-mail or contact Char-Meck Crime Stoppers.

CMPD Officers Arrest Rape & Kidnapping Suspect

On May 18th, CMPD Officers arrested 23-year old Martin Russell Diamond and charged him with 1st degree rape, kidnapping, assault with serious injury, breaking and entering, assault with a deadly weapon and larceny.

According to police, Diamond forced his way into a home yesterday morning and he raped and assaulted an 18-year old girl.  The incident occurred in the vicinity of Curtiswood Dr & Eastway Dr. 

Martin Diamond is currently being held at the Mecklenburg County Jail with a $105,500 bond.

DA: Rapist Found Guilty and Sentenced to 32-39 Years in Prison

On April 14th, 2011, Darryl Thompson, 41, a dangerous criminal with a history of violence against women, was found guilty by a jury of first-degree rape and first-degree kidnapping. Thompson was convicted after a four-day trial.

On September 4, 2005, a woman was walking on the track at Eastway Middle School when Thompson grabbed the woman and raped her on the bleachers. There were no leads in the case until Thompson was arrested in 2008 on an unrelated rape charge and Thompson's DNA was then linked to the 2005 case.

He was sentenced to 32-39 years in prison by The Honorable Jesse B. Caldwell, III, Superior Court Judge. Assistant District Attorney Samantha Pendergrass prosecuted the case. "It really is great to see closure after so long," Pendergrass said. "It affected her life so deeply. Now she knows she's safe."

Man Arrested for Sexually Assaulting 14-Year Old Girl

Carl Walden is currently being held at the Mecklenburg County Jail after he was accused of kidnapping and sexually assaulting a 14-year old girl.

According to police, the young girl told them Walden forced her into his car at gunpoint on Freedom Drive last week and sexually assaulted her. She also stated that Walden told her he had been watching her at the bus-stop and liked to pick up young girls.

The girl was able to jump out of the car and call police. The victim described the suspect's car to the police and told officers where the man stopped. A short time later, Officers found the car and questioned Walden when he admitted to picking up the girl and asking her to have sex for money.

A motion filed in criminal court stated a search of Walden's home turned up several ski masks and a collection of pornography tapes depicting "brutal rape" of women by men in ski masks. Walden wears the ski masks for outside work at Estes Express Line.

In addition, police found several pairs of women's underwear in a jacket pocket located in a closet. In another jacket pocket, detectives found a piece of paper entitled "client list" with names of women officers recognized as murder victims of serial killer Henry Lewis Wallace.

Prosecutors say Walden is also a person of interest in the rape of a 15-year old girl in a park near Rogers Street on January 9, 2011. The victim is unable to identify her attacker because he was wearing a ski mask. Prosecutors are waiting on DNA evidence in this case.

The court motion also offers allegations that a 17-year old was offered a ride home from a movie theater in April of 2009 by Carl Walden and he took her to his home on Rogers Street and sexually assaulted her. Police say Walden told them he wanted to make out with the girl but she started to feel uncomfortable and dropped her off on Freedom Drive.

In June 2006, Walden was also accused of raping a 30-year old woman. Walden claims the woman was a prostitute and was mad after he didn't pay her. The defense asked for a reduction in Walden's bond claiming he's hasn't any convictions for almost 20 years. The prosecution referred to Walden as a sexual predator.

If Walden is able to post his bond, the judge says he will be placed on an electronic monitoring device.... Thank Goodness!

Victim's Mother & Cousin Arrested for her Rape & Murder (Brittini Ward)

UPDATE II:  Dawn Ward has been CLEARED of all criminal charges involving her killing her 23-year-old daughter and having a sexual relationship with her nephew.

UPDATE: Dawn Michelle Ward, the mother of Brittini Ward and the aunt of Derek Ward, was arrested earlier today by deputies with the Lexington County, SC, Sheriff’s Department in connection with the murder of Brittini Ward.

She was arrested without incident at her parent’s home and taken to the Lexington County Detention Center. Ms. Dawn Ward waived extradition and was transported back to Charlotte, NC, by Detectives with the CMPD Homicide Unit, who had previously obtained warrants for her arrest for the following charges: Murder, Accessory After the Fact to a Felony, Incest (with Derek Ward)

Members of the Charlotte-Mecklenburg Police Department’s Violent Criminal Apprehension Team arrested Derek Ward for the murder and rape of his 23-year old cousin, Brittini Ward.

On May 5, 2010, Medic, CFD and CMPD Police Officers were dispatched to a medical call at 8101 Providence Court Lane. Upon arrival, emergency personnel found Brittini Ward inside the apartment deceased.

South Division Officers secured the scene and notified the CMPD Homicide Unit. Homicide Detectives arrived and conducted a death investigation and interviewed everyone present in the home while Crime Scene collected evidence from the scene. The victim was transported to the Medical Examiners Office for an autopsy.

As the investigation continued, Homicide Detectives were contacted by extended family members from out of state with new information regarding the case. Subsequently, Homicide Detectives conducted additional interviews and were able to sign arrest warrants on Derek Ward who was residing at the same address of Brittni Ward at the time of the incident.

Mr. Ward is currently in the custody of the Mecklenburg County Sheriff’s Office charged with Murder and 1st Degree Rape.

Teen Arrested for Rape of 83-year old Woman

UPDATE: 8-11-2011~ Robert Lamar McFadden, 18, was found guilty of second degree rape, felony breaking and entering, misdemeanor breaking and entering, and simple assault. The jury rendered its verdicts in courtroom 5150 of the Mecklenburg County Courthouse.

The District Attorney’s Office successfully presented evidence that this defendant should receive an aggravated sentence. The jury found the crime against the victim to be aggravated due to the victim’s age and physical infirmity. Upon the finding of this aggravating factor, The Honorable Timothy S. Kincaid, Superior Court Judge, imposed a sentence of 9 ½ to 12 years in prison, the maximum sentence allowed by law.

On May 19, 2010, between 5pm and 7:30pm, McFadden broke into the victim’s home at the Mayfield Memorial Apartments, a senior community. McFadden, who was 16 years old at the time of the crime, assaulted and raped the 83-year-old victim, then fled the scene. Officers developed McFadden as a suspect for an assault in March 2010 on another senior citizen and began to search for him.

McFadden was arrested on May 20, 2010, when officers responded to a 911 call reporting that the defendant was breaking into another home in the neighborhood.  A mixture of the defendant’s and victim’s DNA was found on the victim’s bed as well as on a condom that was recovered in the defendant’s neighborhood.

Charlotte-Mecklenburg Police Department Sexual Assault Unit Detectives have charged Robert McFadden, 16, with the residential break-in and sexual assault of an 83-year old female that took place yesterday on Daybreak Drive, located in the CMPD North Division.

Officers responded to a call-for-service in reference to a residential break-in and rape. Medic transported the victim to a local hospital where she was treated and released. Crime Scene Search responded to the scene to photograph it and collect physical evidence.

This afternoon, Sexual Assault Detectives developed probable cause to arrest Mr. McFadden for the crimes. The Violent Criminal Apprehension Team (VCAT) was called upon to assist with the investigation.

Mr. McFadden’s apprehension came as the result of North Division officers responding to another residential break-in this afternoon on the 4900 block of Osage Circle. North Division Officers took Mr. McFadden into custody after a foot pursuit aided by CMPD’s Canine and Aviation Units. Mr. McFadden was transported to the Law Enforcement Center to be interviewed.

McFadden is charged with:
· 1 count of 2nd Degree Rape
· 1 count of 2nd Degree Kidnapping
· 2 counts of Felonious B/E
· 1 count of B/E Auto
· Order for Arrest for violating conditions of release

Mr. McFadden will be transported to the Mecklenburg County Jail where he will remain in the custody of the Mecklenburg County Sheriff’s Office. Detective D. Sexual Assault Unit Arrests Rape Suspect

The Charlotte-Mecklenburg Police Department’s Sexual Assault Unit would like to announce the arrest of Jason Lee Mojica, for a forcible rape that occurred on August 8th, 2007.

The victim in this case reported to police that she was walking in the 7500 block of Forest Point Boulevard when she was approached by two unidentified assailants and forced into the woods where one of the suspects sexually assaulted her.

On March 4 2010, the CMPD Crime Lab contacted the Sexual Assault Unit with identification of the suspect based on biological evidence that was collected. Utilizing this information, along with other evidence in the case, Detectives signed warrants on Mr. Mojica for first degree rape and first degree kidnapping.

CMPD’s Violent Criminal Apprehension Team was contacted and began actively searching for Mr. Mojica. Information was developed to indicate that Mr. Mojica was in New York . VCAT worked closely with the US Marshal’s Service who arrested Mr. Mojica on Thursday, March 11th in the Bronx .

The Sexual Assault Unit would like to thank the Steele Creek Division, the CMPD Crime Lab, VCAT and the US Marshal’s Service for their assistance in the apprehension of this dangerous offender.

Teen Raped After Riding Light Rail Instead Of School Bus

From WSOC-TV: The family of a 17-year-old Charlotte student says a simple phone call from her school might have kept her from being raped. "When she came home, she was shaking real bad and she was crying," the girl's aunt told Eyewitness News.

She said her niece and other students who ride one of Kennedy Charter School's three buses were told just before school let out that their bus had a flat tire, and they would have to ride public transportation home.
But she said no one called parents or other family members to let them know first.

"They didn't call to let us know they were going to send her home on the light rail or ask us to come pick her up," the aunt said.

As a result, the girl and several classmates from Kennedy Charter took the light rail into uptown Charlotte. The girl told police that one of those classmates, 16-year-old Maurice Hunter, attacked her when she got off the train and forced her into a nearby office building where he raped her.

Police arrested Hunter early Thursday and charged him with kidnapping and rape.

Kennedy Charter School officials said they're conducting an internal investigation on the decision to send students home on public transportation, thus they aren't commenting on the case.

But the girl's aunt said they clearly didn't do what they needed to do. "From the time a student gets on the bus early in the morning, till the time that they leave and get to their final destination, they should be responsible for the students -- and my niece didn't get home safely," she said.

Suspect sentenced in a Rape Cold Case

On 11-5-1994, a 17 yr old female was attacked inside her home by a male acquaintance who she knew by an alias name. The suspect tied the victim up with an electrical cord and sexually assaulted her. He was armed with a pistol and attempted to shoot the victim more than once as she fought back. He missed with his shots but was able to strike the victim several times in the head with the pistol itself.

Based on the initial investigation a potential suspect was identified as: Rodney Labrinth Miller. Mr. Miller appeared to have left North Carolina and the case remained open pending further developments.

The Sexual Assault Cold Case Unit obtained a positive forensic match to Miller and prepared the case for prosecution. The Mecklenburg County District Attorneys Office accepted the case for prosecution and warrants were signed on April 28th 2006. Mr. Miller was charged with Attempted Murder, ADW with the Intent to Kill and Inflicting Serious Injury, 1st degree Rape, 1st degree Sex Offense and 1st degree Kidnapping.

Mr. Miller was arrested in Shreveport, LA and returned to Charlotte in July 2008.

On Feb 6th, 2009, Rodney Miller appeared in the Mecklenburg County Superior Court and pled guilty to the above incident. Rodney Miller was sentenced to 22 yrs to 27 years in NC Department of Corrections.

CMPD Arrests Serial Rapist - Sentenced to 35 Years In Prison

UPDATE: 3/30/11- On March 28, 2011, a jury trial began involving the six rape cases against Gilbert McNair. All of the victims were present and ready to proceed with the trial. Pre-trial motions were heard and after the Judge refused to suppress evidence, the 56-year old defendant, entered a guilty plea to all charges. He was sentenced to 35 years to 44.5 years in NC State Prison. Good riddance McNair!!!

The Charlotte-Mecklenburg Police Department Special Victims Unit detectives and VCAT officers arrested Gilbert McNair in reference to four rapes which occurred from 1990 – 1997.

The efforts of CMPD Burglary East Unit, CMPD Crime Lab and the Sexual Assault Cold Case Unit identified Gilbert McNair as the suspect responsible for the following sexual assaults:

1990-----Wakefield Dr-----28 yr old victim
1994-----Crescent Ave----25 yr old victim
1995-----Emerson Dr------21 yr old victim
1997-----Crescent Ave----23 yr old victim

The CMPD and SBI Crime Labs linked DNA evidence collected from the four different scenes, confirming the same person was responsible for committing each of the sexual assaults. Then during a July 2008 arrest a DNA sample was collected from Mr. McNair. This sample matched DNA evidence from each of the four sexual assault cases. All four cases involved First Degree Burglary and Sexual Assault. Mr. McNair broke into the victims’ residences at night while they were asleep. The victims and Mr. McNair were strangers.

Detectives presented the cases to the Mecklenburg County District Attorney’s Office and obtained warrants for Mr. McNair’s arrest earlier today, January 15, 2009. After obtaining the warrants, CMPD’s Violent Criminal Apprehension Team (VCAT) arrested Mr. McNair at 1:17 p.m. VCAT officers were canvassing the 800 block of Woodside Ave when they observed Mr. McNair riding a bike. Mr. McNair was immediately taken into police custody. He was transported to CMPD headquarters where he is currently being interviewed by detectives.

Gilbert McNair has been charged with the following: 4 counts of 1st degree Rape, 4 counts of 1st degree Burglary, 3 counts of 1st degree Sex Offense, 1 count of Attempted 1st degree Sex Offense.

Mint Hill Police Arrest Two Sexual Assault Suspects

On Saturday night, Mint Hill Police officers were dispatched to Carving Tree Lane to investigate a possible breaking and entering and rape that occurred.

Upon arriving on scene, police were advised that a female was physically and sexually assaulted. The woman was transported by Mint Hill Medic to Presbyterian Hospital for treatment.

A short time later, Mint Hill Police were dispatched to the 5700 block of Matthews-Mint Hill Rd. in reference to two unknown people in the backyard of this residence.

Police arrived on scene and found two white male subjects hiding underneath the deck of this residence, which is in close proximity to the crime scene. Both subjects were detained and later arrested for their involvement in the crimes listed above.

The suspects, Gennadiy F. Rizhkov and Ion Svet are being held at the Mecklenburg County Jail under charges of First Degree Rape and Aggravated Assault on a Female. Both suspects are being held without bond.

VCAT Arrests Rape Suspect

On May 21, 2008 at approximately 12:30 p.m., CMPD's Violent Criminal Apprehension Team (VCAT) apprehended Christopher Lamont Cooper- who was wanted for two counts of 2nd Degree Rape, two counts of 2nd Degree Sex Offense and Assault by Strangulation.

VCAT developed information that led them to tracking Cooper through several counties. Officers were able to conduct a successful covert apprehension of the suspect on Montreat Street in Charlotte.

Cooper was aware of his fugitive status and had been actively eluding capture for more than a month. He is currently being held in the Mecklenburg County Jail on $310,000 bond.

Billingsley Road Rapist Arrested

Yesterday morning, a 29-year old woman was brutally raped and beaten with a 2x4 in the Grier Heights neighborhood.

Police say Jequan Sloan (Top) attacked the women on Billingsley Road and brought her to an abandoned apartment where he raped her. The woman attempted to flee after the attack but the rapist caught up with her outside and beat her repeatedly with a 2x4.

Jequan Sloan is charged with attempted murder, rape, sex offense, kidnapping and possession of a firearm by a felon. Sloan is in the Mecklenburg County Jail without bond. In the past three years, Sloan has been arrested 11 times, however, the charges are mostly traffic related.

In addition, CMPD detectives arrested Kevin Martel Laney (Bottom) in connection with the attack. Laney has been arrested by CMPD 18 times in the past three years!

Laney is charged with accessory after the fact and possession of a firearm by a felon. His bond is set at $100,000.
