Mother Crashes into CATS Bus While on Drugs, Infant Son Ejected

On Friday afternoon, a woman was driving her car while under the influence of drugs and caused a car crash that ejected her 2 year-old son from the car.

According to CMPD, Meeyung Park was driving her 2001 Chrysler 300M north on South Tryon Street. At about 3:30 Friday afternoon, Park hit another car before running into a stopped CATS bus and then hitting the median. The accident occurred ner South Tryon's intersection with Kingman Drive, which is near I-77's interchange with Billy Graham Parkway.

During the accident, Park's son, Anthony Lucente, was ejected from the vehicle's back seat and sustained serious injuries. Lucente was in stable condition and is expected to recover. Along with Lucente, his mother and grandmother were transported to Carolinas Medical Center.

At the time of the crash, the CATS bus had seven passengers, one of which was taken to a local hospital. After an initial investigation, Charlotte-Mecklenburg police determined that the child was not property fastened in his car seat. Police also determined that drugs and speed were factors in the accident.

Park is being charged with driving while intoxicated, reckless driving, two felony counts of serious injury by vehicle, a child restraint violation, and failure to reduce speed.

DA's Office: Defendant Tried and Convicted for Abusing 3 Year-Old Child

CHARLOTTE, N.C. –  Timothy John Long, 28, was found guilty of felony child abuse after a jury trial this week. The trial began on Monday, September 17, in courtroom 5130 of the Mecklenburg County Courthouse before The Honorable R. Allen Baddour, Jr., Superior Court Judge.

On August 12, 2010, Long assaulted a three-year-old child for whom he was supposed to be caring. The child, who had a developmental disability, was admitted to Levine Children’s Hospital with a skull fracture.
The jury returned the guilty verdict late Wednesday afternoon. Judge Baddour sentenced Long to the maximum term allowed by North Carolina law: 31-47 months in prison.

Mother Charged With Neglect, Infant Son in Critical Condition

20 year-old Jessenia Gissel Matute has been charged with child neglect after her year-old son is in critical condition. Police say that they are investigating the case but that the Department of Social Services is also involved.

The mother of the boy called police just after 5:00 Monday afternoon. She claims to have left the child in the bathroom alone to return and discover him unresponsive, where she dialed police and attempted CPR on her son.

When police arrived at the residence, located on Firelight Lane's 5300 block, they found the child awake, but he was not responding. He is currently receiving treatment in Charlotte's Presbyterian Hospital.

67 Year-Old Man From Iredell County Charged With Sex Crimes

John Allen McMillian, 67, has been charged with 17 counts of indecent liberties with a child. McMillian, a native of Olin, was apprehended on Friday. His first appearance in court was today.

McMillian was charged after a relative was examined at an area hospital, prompting an investigator from the Department of Social Services contacted authorities in Iredell County. The victim is 5 years old.

Authorities also said another possible victim has come forward in this case. That person allegedly had multiple incidents with McMillian between 1994 and 1995.

Catawba County Man Found Guilty of Sex Crimes

Hickory native James Allen Minyard, 47, was found guilty of a host of sexual charges. He was convicted of 5 counts of indecent liberties with a child and felony attempted first degree sex offense with a child under age 13. In addition to those charges, Minyard was designated a habitual felon.

He was arrested by Burke County sheriffs in 2009 after reports that a child in his care was being assaulted sexually by Minyard. The victim is Minyard's ex-girlfriend's son, according to the Hickory Daily Record. Police say the abuse took place several times from March to August of 2009.

Minyard received a sentence of 225-279 months in prison and has denied his guilt.

Couple Arrested For Running Meth Lab With Children in Home

Thomas Wyatt, 37, and Julia Hvostel, 27, both of Jefferson, have been arrested on drug charges after Ashe County Sheriff's had reason to believe the couple were operating a meth lab in their home with their two small children.

They have been charged with manufacturing a control substance and maintaining a dwelling for sale and delivery of a controlled substance.

Their children were taken to Ashe Memorial Hospital before being released to the Department of Social Services.

Hvostel, the mother of the children, is being jailed under a $55,000 bond. Wyatt is the stepfather of the two children and is being jailed under a $50,000 bond. The couple still face pending charges pertaining to their children.

Former Basketball Coach From Hickory High Charged With Taking Indecent Liberties With Former Students

Shawnacie Johnson, the former head coach of the Hickory High School men's basketball team, is now facing five charges of indecent liberties with 2 former students.

Johnson, 38, was indicted last month when a second alleged victim, also a former student, went to authorities. Johnson allegedly had sex with a then 14 year old student multiple times from 2007 on, according to court documents.

Step-father Charged with Felony Child Abuse

Joshua Houser, 22, is facing felony child abuse charges for critically injured his 3-year old step-daughter after hitting her with a blunt object.

The victim was transported to Jeff Gordon's Children's Hospital to be treated for her injuries.

According to the Union County Sheriff's Office, Houser was arrested on Thursday night in the 9000 block of Covey Trail, which is located in Indian Trail.  He is being held on a $1 million bond.

35-Year Old Charged with Statutory Rape after 14-Year Old Gives Birth

Juan Martinez Hernandez has been charged with statutory rape after a 14-year-old girl gave birth to his child on Sunday.  Police say the girl gave birth to the baby in the bathroom of an apartment near East Arrowood Road.

Her family called 911 and the responding paramedics asked police for assistance. The girl told the police officers who the baby’s father was- a man who lived in the neighborhood and Charlotte-Mecklenburg police found and interviewed Juan Martinez-Hernandez.

Hernandez “admitted to engaging in sexual intercourse with the victim on several occasions,” according to the police report. Hernandez was charged with four counts of statutory rape and two counts of indecent liberties with a child. He is in jail at the Mecklenburg County Sheriff’s Office under a $250,000 bond.

Immigration reports show that Martinez-Hernandez was deported from the US in 2010.

Mom Charged with 10 Counts of Child Abuse/Neglect

Youth Crime Detectives with the Charlotte-Mecklenburg Police Department have arrested Lodonna Parlier after an investigation revealed the suspect had abused her infant daughter on several occasions.

On February 2, 2012, at approximately 2:40 a.m. Providence Division Officers were dispatched to Carolina Medical Center Main to investigate alleged abuse and charges were filed after a joint investigation with the Department of Social Services.

Ladonna Parlier was taken into custody and charged with five counts of child abuse and five counts of child neglect. The child remains in CMC Main and is listed in stable condition. The assistance from CMC staff was critical in this investigation.

Child Molester Convicted & Sent to Prison for 32 years

On October 26, 2011, Michael McDaris, age 63, was convicted of two counts of statutory rape. The jury rendered its guilty verdict after a three day trial held in front of the Honorable Robert C. Ervin, Superior Court Judge in the Mecklenburg County Courthouse.

McDaris repeatedly molested and raped a teenage family member over a period of years between 2003 and 2004. The victim was 14 and 15 years old at the time that she was raped by the defendant. The victim in that case was afraid to come forward until five years later, when she decided to report the crimes to the Mint Hill Police Department.

The victim, now 23, testified in front of the jury this week about the years of abuse she suffered at the hands of the defendant. The defendant gave a statement to the Mint Hill Police admitting the molestation and rape of this girl. After all of the evidence was presented, the jury deliberated for approximately an hour and ten minutes before rendering their verdict of guilty, as charged, to both counts of statutory rape.

At sentencing, the victim and her mother read victim impact statements to the Court. The victim told the judge that testifying against the man who raped her was the hardest thing she had ever done, but that after the verdict she “felt free and was now a survivor.”  She also asked the judge to sentence the defendant to two consecutive prison sentences for the rapes. Judge Ervin sentenced the defendant to a minimum of 192-240 months in prison for each charge; he will serve a total sentence of 32-40 years in prison.

Young Girl Killed in Accidental Shooting on Archdale Drive

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and Assault with a Deadly Weapon Unit are conducting an investigation into a shooting which left a 4-year old girl dead on Archdale Drive at 1:22 this afternoon.

CMPD Steele Creek Division Officers responded to an apartment at the Highlands Apartment Complex to investigate reports of a shooting with injury.  Officers arrived on the scene to find the CFD and Medic treating a 4-year old girl for a gunshot wound.  She was transported to Carolinas Medical Center where she was pronounced deceased.  

Homicide Detectives are in the process of interviewing the other young children and the adult who was inside the apartment at the time of the shooting.  A total of 5 children, including the victim, were inside the apartment at the time of the shooting with ages ranging from 6 months to 11 years old.

Detectives charged Mr. Erin Melendez with Storing a Firearm in a Manner Accessible to a Minor.  CMPD says they are not looking for any suspects in connection with what is believed to have been an accidental shooting.

Detectives with the Special Victims Division assisted in the investigation as well as clinicians with the Child Development-Community Policing (CDCP) Program. The CDCP is a partnership between the CMPD and Mecklenburg County Provided Services Organization.

Father Charged with Felonious Child Abuse

Terrell Nelson, 27, was arrested early this morning and charged with two counts of felony child abuse- inflicting serious injury.  Nelson is accused of abusing his two 3-month old daughters.

CMPD says the investigation into the child abuse started on Friday after the baby girl's mother, LaShonda Young, found her child unresponsive and called 911.  The baby, Cy'mone Nelson, was taken to Presbyterian Hospital where she was diagnosed with head trauma, facial bruising, left eye damage and a subdural hemorrhage.

After this incident, DSS interviewed the father and checked the other two children for injuries.  Doctors found non-accidental injuries on both of the girls, Caileigh & Cy'mone Nelson but the boy was left unharmed.  According to a search warrant, the injuries to both girls were consistent with "felonious assault" and "non-accidental trauma."

LaShonda Young, the mother of the triplets, told police that she witnessed Terrell Nelson "place tape on the infants pacifiers on more than one occasion,"  During a search of the home, police took pacifiers and roll of tape on the loveseat.

Terrell Nelson is being held in the Mecklenburg County Jail on a $70,000 bond and the two infant girls remain in the hospital.

Man Charged after Abused Child Dies at CMC

UPDATE:  Thursday, September 22-  Homicide Unit Detectives have arrested Ariacna Janet Romero and charged her with Accessory after the Fact (Felony) in relation to the murder of her son, Demytre Rashaad Pendleton Jr.

On August 24, 2011, at 10:24 pm, Steele Creek Division officers responded to Carolinas Medical Center–Main in reference to a two year old male, Demytre Rashaad Pendleton Jr., who was admitted to the hospital with a skull fracture. Demytre had several bruises and a skull fracture that were deemed possibly consistent with a fall.

Detectives with the Youth Crimes Unit were assigned to investigate the incident. Demytre was subsequently treated and released from CMC, while the detectives continued their investigation.

On September 7, 2011, at 7:18 pm, Detectives with the Youth Crimes Unit were dispatched to Carolinas Medical Center-Main in reference to Demytre being brought back to the hospital by his mother on September 6, 2011. Demytre was brought to Carolinas Medical Center-Pineville and then flown by helicopter to Carolinas Medical Center-Main, where an examination revealed new injuries that were severe enough to contact the CMPD. Demytre passed away early on September 9, 2011, as a result of his injuries.

Homicide Unit Detectives have charged James Gregory Cleveland with Felony Child Abuse Inflicting Serious Bodily Injury or Mental or Emotional Injury and Murder in relation to the death of Demytre Rashaad Pendleton. Mr. Cleveland has been transported to the Mecklenburg County Sheriff’s Office, where he will remain in their custody. Mr. Cleveland is a friend of Demytre’s mother; he is not related to Demytre.

Mother Charged with Child Abuse after Son's Head Injury

UPDATE: On July 14, 2011 at 5:40 pm, the victim succumbed to his injuries and was pronounced deceased as a result of the injuries sustained on July 10, 2011.  Family notification has been made and the victim has been identified as Marcus Markee Davis Jr.

Shortly after 1:00 a.m., on Wednesday, July 13, 2011, Shannon Merriman was arrested on a warrant for Child Abuse Inflicting Serious Injury (Felony).  Ms. Merriman is currently in the custody of the Mecklenburg County Sheriff’s Office, where she is being held without bond.  Ms. Merriman was arrested at Carolinas Medical Center.
 
The victim in this case is the one year old son of Ms. Merriman; his name is being withheld.  The incident occurred at Ms. Merriman’s apartment, located on High Meadow Lane, in the Steele Creek Division, on July 10, 20011, at 2:34 p.m.  Ms. Merriman called 911 to report that her son had slipped and hit his head.  

Steele Creek Division officers responded to the scene and to Carolinas Medical Center, where the baby was taken for treatment of his injury.  Homicide Unit Detectives were notified and took command of the investigation from the outset.  Their investigation led them to secure a warrant for Ms. Merriman’s arrest.

Mother Admits Guilty Role in the Deaths of her Two Children

On February 28, 2010, at 6:06 am, CMPD and the Charlotte Fire Department (CFD) were dispatched to a house located at 920 Rowan Street in response to a house fire. There were four children located at the scene who had been inside the house at the time of the fire.  Two of the children, Miracle (age 7) Elisha (age 4) were able to escape, however; their two younger brothers, 14-month-old Gabriel Hawthorne and 26-month-old Josiah Hawthorne, were found deceased inside the house.

The Medical Examiner determined the cause of death for both Gabriel and Josiah Hawthorne to be smoke inhalation/carbon monoxide toxicity due to house fire. The fire investigation performed by the CFD determined that the fire started in the bedroom where the children had been sleeping.

Orgal Paulette Opata, age 27, is the biological mother of all four children and lived with them at the house located at 920 Rowan Street. Opata left the four children home alone in the early morning hours of February 28, 2010, while she went out with a friend. While left unattended, one of the children began to play with the heater and it caught fire. Opata was charged in connection with the house fire and resulting deaths of Josiah and Gabriel. Opata admitted that she left her children alone that night while she went out and, that when she left, the kerosene heater was on.

Opata stated that the kerosene heater was the only heat source in the home and that she and her children had spent that entire winter living at 920 Rowan Street without central heat. They also had no hot water at their house except for a couple of weeks in November 2009. The house they had lived in the previous winter had no central heat and they used space heaters at that house in an attempt to stay warm.

Opata chose to spend money on things other than the heat during the winter months (her nails, hair, clubs, etc.) while her children were subjected to living in the cold. On February 28, 2010, by leaving the children alone with a kerosene heater, Opata acted in such a reckless and careless manner as to show a thoughtless disregard for consequences and a heedless indifference to the safety of her children and is therefore guilty of Involuntary Manslaughter for the deaths of Josiah and Gabriel Hawthorne.

Opata plead guilty to two counts of Involuntary Manslaughter, three counts of Felony Child Abuse and four counts of Exposing Children to Fire. All of the sentences are in the aggravated range under North Carolina’s sentencing guidelines and will run consecutively for a total prison sentence of 10-13 years in prison.  The aggravating factors that apply to this case are N.C.G.S. 15A-1340.16(d)(6): the offense proximately caused serious injury to a firefighter; (d)(11): the victims were very young; (d)(15): the defendant took advantage of a position of trust or confidence, including a domestic relationship, to commit the offense.

Opata was sentenced by The Honorable W. Robert Bell, Superior Court Judge, of the Mecklenburg County Courthouse. Prior to this case being resolved in court, the assigned prosecutor met with Josiah and Gabriel’s biological father, Jerry Hawthorne, as well as their paternal grandmother, Alesia Greene.

** Opata was arrested in October of 2009 when her baby was found wandering alone on the streets in a diaper and t-shirt.  She was charged with 3 counts of neglect.  Where was DSS???  Opata always had nice hair and nails but couldn't afford to pay for heat and DSS found her a decent mother?  She had four children at home but it was more important for her to go out clubbing, pick up a guy and go off to a motel, while her two children died in a house fire AND WE GIVE HER ONLY 10 YEARS IN JAIL???  This is sick!  Who is advocating for the children in this city?

Man Pleads Guilty to Child Sexual Assault Charges

Tristan Kiel Russell, 29, has plead guilty to three sex assault charges on a minor and was sentenced to more than 13 years in prison after he admitted to sexually assaulting a 13-year old boy between 2009-2010.

Prior to his arrest, Russell was an instructor at Providence Day School's after school and summer programs for two years, however, the incidents with the boy did not occur on campus.  After Tristan Russell is released from prison, he will be required to be electronically monitored for the rest of his life.

Mom Leaves Children Unattended: Two Die in House Fire

Case Update: Orgal Paulette Opata has been charged with the following crimes in connection to the fire which caused the deaths of two of her young children:

* Four Counts G.S. 14-318 Exposing a Child to Fire
* Three Counts G.S. 14-318.4 (a) (4) Reckless/Gross Felony Child Abuse
* Two Counts of Murder
* One Count G.S. 14-69.3 Burning Resulting in Serious Injury to a Fire Fighter

Ms. Opata remains in the custody of the CMPD and will be transported to the Mecklenburg County Sheriff’s Office. This is Opata's second arrest on child neglect charges.

Charlotte-Mecklenburg Police Department Homicide Unit Detectives are assisting the Charlotte Fire Investigation Task Force with an investigation into an early morning fire which resulted in the deaths of two young brothers. The two boys have been identified as 2-year old Josiah Hawthorne and 1-year old Gabriel Hawthorne. The call for service came in at 6:06 a.m., on Sunday, February 28, 2010.

This investigation is in its early stages. At this point, we can confirm that the two youngsters who passed away were left alone inside their home along with two older siblings, a 4-year old boy and a 7-year old girl, who both made it out alive with the assistance of a neighbor. Detectives are currently conducting interviews to determine who was responsible for leaving the children unattended. At this preliminary stage it appears that this fire was accidental in nature and not intentionally set.

Crime Scene Search responded to the scene to photograph it and collect physical evidence. The Fire Investigations Division, Homicide Unit and the Special Victims Unit responded to the scene to aid in the investigation.

Infant Murdered by Mom's Boyfriend

On January 22, 2010, CMPD Providence Division officers responded to a call for service at the Levine Children’s Hospital at Carolinas Medical Center in regards to a 6-month old infant with injuries suspected to be “non accidental” in nature. Hospital staff informed the officers that the child, London Brantley was unresponsive and being treated for injuries.

Detectives continued to investigate the circumstances around the infant’s injuries and interviewed the mother and her boyfriend while hospital staff performed further testing to gain more information.

With the developments from the interview and the hospital, Homicide detectives arrested Juan Sabastian Vega, for Felony Child Abuse and Murder. Vega is not the child’s father, but the boyfriend of the infant’s mother. The infant passed away on January 23, 2010.
